1. Acceptance of Terms

By downloading, installing, or using the KidWin mobile application (“App”) or visiting kidwinapp.com (“Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App or Site.

KidWin is operated by Clearline LLC (“we,” “our,” or “us”).

2. Description of Service

KidWin is a developmental play recommendation app for parents and caregivers of children ages 0–8. The App uses AI to generate personalized activity suggestions based on a child's age, personality, and developmental needs.

KidWin is not a medical device, therapy tool, or substitute for professional child development assessment. Activities are suggestions for play-based enrichment and should be supervised by a parent or caregiver.

3. Eligibility

You must be at least 18 years old to use the App. The App is designed for use by parents and caregivers, not by children directly.

4. Accounts

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Subscriptions and Payments

KidWin offers both free and paid subscription plans. Paid subscriptions are billed through Apple's App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.

  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period
  • You can manage and cancel subscriptions in your Apple ID account settings
  • Refunds are handled by Apple in accordance with their refund policy
  • Free trial eligibility is determined by Apple and may be limited to one trial per Apple ID

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's functionality
  • Use the App to generate content that is harmful, abusive, or inappropriate
  • Resell, redistribute, or commercially exploit the App or its content

7. Intellectual Property

All content, features, and functionality of the App — including text, graphics, logos, and software — are owned by Clearline LLC and are protected by copyright, trademark, and other intellectual property laws.

Activities generated by the App are provided for your personal, non-commercial use. You may share individual activities but may not systematically reproduce or redistribute them.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Activity recommendations are AI-generated suggestions, not professional developmental assessments. Always supervise children during activities and use your judgment regarding safety and appropriateness.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARLINE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Clearline LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
